PATSy - Terms and Conditions

PATSy is accessible via the Internet but it is a restricted Web-site. This means that access to PATSy is subject to password control and its use is controlled and monitored by the PATSy administrator. PATSy offers different levels of access to the user:

  • Full access (includes video of cases) is only available to PATSy-subscribers who are statutory registered education, research and health organisations.
  • Data-only access (minus the video i.e. full anonymity) of specific cases is available for off-site education and research.

Continued access to the PATSy system by all subscribers is reviewed annually.

PATSy operates on a no-profit, co-operative model in which subscribers contribute to, and use PATSy as a facility for communicating ideas and disseminatin research. The addition of test data from new cases will however, incur costs as well as subsequent replacement of equipment and general maintenance of the system. To cover these costs, a nominal charge in the form of a subscription is necessary. Any surplus income generated by the PATSy team from activities related to PATSy will also be used to support the system. The departments of individuals who contribute a new case may, following consultation with PATSy's project Directors, claim for the costs incurred in data installation up to an agreed amount. The PATSy annual subscription covers access to patient data, user-documentation, on-line technical support, access, on request, to user training sessions held at a PATSy base site. The subscription fee is reviewed annually.

Definition of terms:

PATSy subscriber:
A teaching department, a research centre or a hospital or health centre represented by a Head of Department or person whose office permits official representation of the subscriber.
PATSy user:
Any person granted a username and password to use the PATSy system.
PATSy administrator:
Any person in a subscribing department, centre or hospital granted special permission to locally control access to the PATSy system. There will generally be two such persons for each subscribing department or institution.
PATSy system:
The PATSy web site, data, software and design. Also referred to as PATSy.
PATSy data:
All patient and test data on the PATSy system.
PATSy software:
All code, scripts and data formats used to add, extract, store and display data in the PATSy system.
PATSy design:
The PATSy logo, icons, and associated look and feel of the PATSy web site.
The PATSy team:
Those responsible for the conceptual design and for the implementation of the PATSy system, namely: Richard Cox, Carmel Lum and Jonathan Kilgour.
PATSy Directors:
Those responsible for managing PATSy, namely: Carmel Lum and Richard Cox.
Site:
The subscribing Department.
Base Site:
Refers to sites at which members of the PATSy specialist teams are located. Currently, these sites include University of Cambridge, University of Edinburgh, University of Sussex and the University of Newcastle Upon Tyne.

Users

The terms and conditions of use are:-

  1. PATSy may only be used for education and research purposes.
  2. PATSy users must treat medical records, data, information and multimedia files of the patients in the PATSy system in the same way as they treat those of real patients in terms of ethical considerations, privacy and confidentiality. Users must respect the fact that the data within PATSy is from real patients.
  3. All PATSy users must be registered through an authorised educational establishment which subscribes to PATSy. Access by members of the public, whether at a subscribing site or via remote access, is not permitted.
  4. PATSy users are issued with a password which must remain confidential and used only in the context of (5). These passwords are non-transferrable. Those to whom usernames and passwords are issued must not disclose them to anyone else either deliberately or through neglect.
  5. PATSy users must undertake to exit their browser after each PATSy session. Failure to do so may compromise PATSy security. It is preferable that users shut down their machines after a session, but this may not be appropriate in certain circumstances.
  6. The PATSy data is covered by the Data Protection Act, and subscribing institutions must conform to this act. PATSy users should be aware of the conditions of this act and must treat the PATSy data as confidential
  7. The PATSy system is provided as is, with no guarantee of fitness for any particular purpose. There is no guarantee of uninterrupted service of the PATSy web site, nor is there a guarantee of the PATSy web site's performance in terms of its speed, efficiency and availability. To the extent it is permitted by law to do so, the PATSy team excludes all liability arising from use of the PATSy system other than liability for death or personal injury.
  8. While the PATSy team has made every effort to ensure the accuracy and fidelity of the PATSy data; we make no guarantee that the data is 100% accurate or complete.
  9. All PATSy data is subject to copyright and may not be reproduced in any format. No user may actively copy any data from PATSy onto any removable media without prior permission.
  10. The copyright on the PATSy software is held by the PATSy team.
  11. The copyright on the PATSy design is held by NXYS Ltd.
  12. The copyright on individual tests (including text and other media) is held by the publisher of that test, or where the test is not published, by the test author.
  13. The right to alter and modify the nature and content of the PATSy web site and data is reserved.
  14. Any academic paper which refers to the PATSy system, must make a full citation of the system, including the URL. See PATSy page

  15. Any academic paper which refers to specific patient data and test information on PATSy, must reference the individual(s) who provided the data.
  16. If any commercial developments arise from your work using the PATSy system then you will inform the PATSy team immediately.
  17. By continuing to use PATSy, you are confirming that you have read, understood and accept these terms and conditions.
  18. We reserve the right to terminate a user's access to the PATSy system if we have reasonable grounds for believing these terms and conditions have been or are likely to be breached.
Administrators

Administrators are bound by the terms and conditions for users with the addition of the following:

  1. PATSy administrators will be responsible for the appropriate and legal use of the PATSy system at their particular site. They must regularly check user logs and inform the PATSY team of any unusual or suspicious usage.
  2. PATSy administrators must only provide passwords to users within their department / institution.
  3. PATSy administrators must be able to name all users on their site, and provide email addresses where possible.
  4. Where errors are encountered in the data or software of the PATSy system, PATSy administrators will inform the PATSy team.
Subscribers

Subscribers are bound by the terms and conditions for users and administrators, with the addition of the following:

  1. Subscribers shall take all reasonable steps to prevent unauthorised use including making reasonable efforts to inform users of these Terms and Conditions.
  2. PATSy should only be used for education and research purposes. PATSy may be used by subscribers as a component of income-generating activities (e.g. continuing education workshops) but subscribers must inform the PATSy Directors if they do so. Subscribers and users may not charge users for access to PATSy.
  3. Off-site access to PATSy via dial-in modem is only permitted via dial-in services provided by the subscriber's institution.
